Please understand that the "Terms of Use" are provided for both your protection and mine; they are written to clarify the terms under which the images contained within this collection may be used. These terms are legally binding. These terms may be altered at any time.

Artworks, characters, written works/stories, titles, logos, etc. posted by Elena D. Smith-Martinez (blinkythered.com and all other websites) may be used only in accordance with the terms listed below. All content posted by BlinkyTheRed is the property of Elena D. Smith-Martinez, Copyright Elena D. Smith-Martinez, unless stated otherwise, and some if not most is prohibited from use, as specified in the Terms of Service below:

1. Artworks, written works/stories, characters, titles, logos, etc. are prohibited from being altered, stolen/taken, borrowed, re-colored, resized, and anything else you may come up with, unless given written permission, which you will have to gain by personally contacting me. That includes turning my works into wallpapers, website designs, uploading it as a preview image, adding borders, cropping them, turning artworks into brushes, filters, tubes, screensavers, nozzles, patterns, fonts, or any other current or future software plugin.

2. Artworks, written works/stories, characters, titles, logos, etc. are not for commercial use, including selling and displaying my works on commercial pages, and you will never be granted permission to do so.
---Any site whose intent it is to earn revenue (whether it be actual income and/or bartered for trade) is considered a commercial endeavor.

3. You are permitted to save my artworks onto your computer, for personal viewing only (and nothing else), and that does not include logos, titles, written works/stories, and characters. If you must share, you direct a person to my personal website, DeviantArt page, Xanga page, LiveJournal account or Y-Hosting gallery.

4. Printing and displaying my work, unless for personal use only, is prohibited. Displaying any of my material on your personal website is prohibited.

5. Under no circumstances are you to remove the watermarks and/or signatures.

6. Reproducing my works in any way is prohibited. In addition, my works are not to be placed in any online collection or archive. No images are to be redistributed for financial gain or placed within any compilation CD, software or other reproducible media.

7. You may not use my artworks to represent your characters, for preview images in written works, or anything else that constitutes borrowing/taking, without being granted permission, which again you will have to obtain by contacting me personally.

8. If, for whatever reason, you have been given permission to use any of my works, in whatever way, you will be checked up on regularly. Regardless of being given permission, you are not to alter or reproduce my works in any way, and will be allowed to upload/display my works only on specified web pages.

9. Please refrain from using my works anywhere that promotes child abuse, hate, bigotry, racism, animal abuse and/or illegal pornographic activities.

10. If for any reason I request that my works you might have been given permission to use be removed from your site, you will be given 72 hours to comply before legal action is taken.

11. Regardless of whether or not an image has my signature or website address on it, the image still copyright to me unless I specifically credited said material to someone else. This image is still protected by my Terms of Services.

Violating these terms will result in my taking steps to getting my works off your website (and wherever else you might have been using them) personally, among other things. Simply put, do not use my work, period. Contacting me can easily be done through e-mail (blinkythered AT gmail DOT com), or through the respective messaging systems on my various online portfolio accounts.
